Welcome to Sasquash Cloud Service (“Sasquash”, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website, applications, software, cloud services, storage services, and related offerings (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.

  1. Eligibility

You must be at least 18 years old or have the legal capacity to enter into a binding agreement under applicable law. By using the Services, you represent and warrant that you meet these requirements.

  1. Account Registration

You may be required to create an account to access certain Services. You are responsible for:

  • Maintaining the confidentiality of your account credentials;
  • Restricting access to your account;
  • Ensuring that the information you provide is accurate and up to date; and
  • All activities that occur under your account.

You must notify us immediately of any unauthorized use of your account.

  1. Acceptable Use

You agree not to misuse the Services or assist others in doing so. The following activities are prohibited, including attempts to perform them:

  • Testing, scanning, or probing the vulnerability of any system or network;
  • Breaching or circumventing security or authentication measures;
  • Accessing, tampering with, or using non-public areas of the Services or shared areas to which you have not been granted access;
  • Interfering with or disrupting any user, host, or network, including by transmitting malware, overloading, flooding, spamming, or mail-bombing any part of the Services;
  • Sending unsolicited communications, advertisements, promotions, or spam;
  • Sending altered, deceptive, or false source-identifying information, including spoofing or phishing;
  • Promoting or advertising products or services that are not your own without appropriate authorization;
  • Circumventing storage, bandwidth, or usage limitations;
  • Reselling, sublicensing, or commercially exploiting the Services without our written permission;
  • Publishing, storing, or sharing unlawful pornographic, obscene, or otherwise illegal content, or content depicting extreme violence or terrorist activities, including terrorist propaganda;
  • Promoting hatred, harassment, discrimination, or violence against individuals or groups based on religion, ethnicity, nationality, gender, gender identity, sexual orientation, disability, or similar protected characteristics;
  • Violating any applicable law or regulation, including by storing, publishing, or sharing fraudulent, defamatory, deceptive, or misleading content;
  • Violating the privacy, intellectual property, or other rights of any person or entity.

We reserve the right to investigate violations and suspend or terminate accounts that breach these Terms.

  1. User Content

You retain ownership of any content, files, data, or materials you upload, store, transmit, or otherwise make available through the Services (“User Content”).

You grant Sasquash a limited license to host, store, process, transmit, and display User Content solely as necessary to provide the Services.

You represent and warrant that you have all necessary rights to use and share User Content through the Services.

  1. Service Availability

We strive to provide reliable Services but do not guarantee uninterrupted, secure, or error-free operation. Services may be modified, suspended, or discontinued at any time.

  1. Fees and Payments

Certain Services may require payment. You agree to pay all applicable fees and taxes. Unless otherwise stated, fees are non-refundable except where required by law.

We reserve the right to change pricing upon reasonable notice.

  1. Intellectual Property

The Services, including software, trademarks, logos, designs, and related materials, are owned by Sasquash or its licensors and are protected by intellectual property laws.

Except as expressly permitted, you may not copy, modify, distribute, reverse engineer, or create derivative works from the Services.

  1. Suspension and Termination

We may suspend or terminate your access to the Services at any time if:

  • You violate these Terms;
  • We are required to do so by law;
  • Your use poses a security, legal, or operational risk; or
  • We discontinue the relevant Service.

You may stop using the Services at any time.

  1. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SASQUASH DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY.

  1. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SASQUASH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL.

IN NO EVENT SHALL SASQUASH’S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

  1. Indemnification

You agree to indemnify and hold harmless Sasquash, its affiliates, officers, employees, and partners from any claims, damages, liabilities, losses, and expenses arising out of your use of the Services, your User Content, or your violation of these Terms.

  1. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

  1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Sasquash is established, without regard to conflict-of-law principles.
